Terms of Service

"Rose + Thyme", "we", "us", and "our" refer to the operator of therosethyme.com. You can reach us at admin@therosethyme.com.

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By ordering, you represent that you meet this requirement and that the billing and shipping information you provide is accurate.

We work hard to describe our products accurately, but we don't warrant that descriptions, images, colors, or other content are 100% error-free, complete, or current. Colors may appear differently on different screens. Ingredient lists are kept up to date, but small-batch production means batch-to-batch variation is possible and expected.

All prices are listed in US dollars. We reserve the right to change prices, modify or discontinue products, and limit order quantities at any time, without notice. If a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to cancel the order and issue a refund.

Placing an order is an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inventory issues, or pricing errors. If we cancel an order after you've paid, we'll issue a full refund to your original payment method.

Once you receive an order confirmation email, your order is accepted. We'll send a separate email with tracking information when the package ships.

Payments are processed by PayPal, which accepts PayPal balances, major credit and debit cards (Visa, Mastercard, American Express, Discover), and PayPal Pay Later where eligible. By providing payment information you authorize us (through PayPal) to charge the full order amount, including any applicable taxes and shipping fees, at the time of purchase.

We do not store your credit or debit card number on our servers. All card data is handled entirely within PayPal's PCI-compliant infrastructure.

We collect sales tax on orders shipped to US states where we have a tax obligation, at the rate applicable for the destination address. International orders may be subject to import duties or VAT charged by the destination country's customs; those charges are not included in our prices and are the customer's responsibility.

We ship via USPS, UPS, FedEx, or DHL depending on destination. Estimated transit times:

• United States: 3–7 business days
• Canada: 5–10 business days
• International: 10–21 business days

US orders over $75 ship free; below that, US shipping is a flat $6. Canada is a flat $15. International is a flat $25. Exact shipping cost is shown at checkout.

Risk of loss and title for items pass to you upon our delivery of the package to the carrier. If your package is lost or damaged in transit, please contact us within 14 days of the estimated delivery date and we'll work with the carrier on a claim.

We want you to love what you order. If you're not satisfied, contact us at admin@therosethyme.com within 30 days of delivery and we'll work with you on a resolution.

Unopened items in original condition may be returned for a refund of the product price. Return shipping is at the customer's expense unless the item arrived damaged or was sent in error.

Opened items generally cannot be returned for hygiene and safety reasons. However, if a product caused a reaction or didn't perform as described, contact us — we'll consider a replacement or refund on a case-by-case basis and always try to make it right.

Refunds are issued to the original payment method within 5–10 business days of receiving the returned item or approving the claim.

Discount codes are single-use unless explicitly stated otherwise, valid only for the time period specified, and cannot be combined with other promotions, sales, or discount codes (one code per order). Welcome codes from our newsletter signup are valid for 30 days from issue and expire after a single use.

We reserve the right to cancel, modify, or refuse to honor any discount code that is being misused, was issued in error, or has expired. Promotional pricing adjustments are not retroactive — codes must be applied at the time of checkout.

If you sign up for our newsletter, you consent to receive marketing emails from us about new launches, restocks, brand stories, and promotions. You can unsubscribe at any time via the link at the bottom of any email, or by emailing us. Transactional emails related to your order (confirmations, shipping notifications) are sent regardless of marketing-email preferences.

Our products are cosmetics intended for external use only. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease. Statements about our products have not been evaluated by the US Food and Drug Administration.

Before first use: apply a small amount to a discreet patch of skin (e.g. inner forearm) and wait 24 hours to check for any reaction. Discontinue use immediately if irritation, redness, swelling, or any unusual reaction occurs, and consult a healthcare professional if symptoms persist.

Do not use on broken, irritated, or compromised skin unless specifically directed. Avoid contact with eyes; if contact occurs, rinse thoroughly with water. Keep out of reach of children.

If you have allergies, are pregnant or nursing, are taking medication, or have a medical condition, consult a healthcare professional before using any new skincare product. Always read the ingredient list before use.

All content on the site — including product names, descriptions, photography, graphics, logos, and the "Rose + Thyme" brand — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent, except for personal, non-commercial use such as browsing or printing for your own reference.

If you submit content to us — for example, a review, a question, or a photo — you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display that content in connection with the site and our marketing, with attribution where reasonable. You represent that you own or have permission to share the content and that it doesn't infringe anyone's rights.

You agree not to:

• Use the site for any unlawful purpose or in violation of these Terms.
• Resell our products without our prior written authorization.
• Attempt to access non-public areas of the site, our servers, or our infrastructure (including but not limited to the admin interface, API endpoints, or backend database).
• Scrape, crawl, or use automated means to access the site at a rate that disrupts service, except for well-behaved search-engine crawlers respecting robots.txt.
• Reverse engineer, decompile, or disassemble any part of the site.
• Use any device, software, or routine to interfere with the proper working of the site or to impose unreasonable load on our infrastructure.
• Submit false personal information, place fraudulent orders, or use someone else's payment method without authorization.

The site and our products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the site will be uninterrupted, secure, or error-free, or that defects will be corrected. Individual results from our products may vary based on skin type, usage, and other factors.

To the fullest extent permitted by law, in no event will Rose + Thyme, its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation lost profits, lost data, personal injury, or property damage — arising out of or related to your use of the site or our products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the site will not exceed the greater of (a) the total amount paid by you to us in the six months preceding the event giving rise to the liability, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages — in those jurisdictions, the exclusions and limitations above apply only to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Rose + Thyme and its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the site, (b) your violation of these Terms, or (c) your violation of any third-party right.

We may suspend or terminate your access to the site at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.

We may update these Terms from time to time. When we make material changes we'll update the "Last updated" date at the top of this page. Your continued use of the site after a change means you accept the updated Terms.

These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law provisions. The federal and state courts located in Oregon have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the site, except where prohibited by applicable consumer-protection law.

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting admin@therosethyme.com. If we cannot resolve the dispute within 30 days of notice, either party may initiate formal proceedings in a court of competent jurisdiction in Oregon.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rose + Thyme regarding the site and your purchases. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign them freely.
